- for advice on the apportionment of liability
between two ships in collision at sea
Apportioning liability for a collision at sea requires:
(1) a detailed knowledge of the applicable rules and the relevant case law; and
(2) a proper understanding of how the applicable rules should be interpreted and applied by the courts.
Very few collision practitioners today possess both (1) and (2).
We do.
We provide this expertise promptly and at a very competitive price.
The apportionment of liability has a significant impact on the financial outcome of every collision case. It always pays therefore, to get an expert advice on this issue, and as soon as is reasonably practicable.
We recognise that other marine experts will be more conveniently located and better equipped to investigate a collision at sea; to collect and analyse the relevant evidence.
We do not do this.
We focus on examining the collected evidence and the expert's analysis and providing advice on the apportionment of liability for the collision.
The company was founded by Harry Hirst, an ex-master mariner and retired marine lawyer, . During his legal career Harry worked almost exclusively on cases involving collisions between ships at sea, acquiring over 30 years experience of advising ship owners and their insurers on the likely apportionment of liability for these collisions under English law. He is the author of the book Collisions at Sea - Volume 1: Liability and the Collision Regulations; Volume 2: Case Studies, and has written papers commenting on English and other court judgments in collision cases (see Publications). When he retired from the law, he was recognised to be "a figurehead in the shipping industry" with "a wealth of experience in shipping disputes" (Chambers). The company is uniquely qualified therefore, to provide such advices, and specialises in doing so. If you require such an advice, whether as an initial report or as a second opinion, then please do not hesitate to contact us.
